When a couple is married for a long period of time in Sarasota, and decides to divorce, there is usually a great deal of property at stake. In some cases, there may be a prenuptial agreement in place which determines what a spouse will receive. However some couples do not have an agreement and this can lead to a high asset divorce. These kinds of divorces often can turn into court battles as couples argue over property division issues.
Celebrity chef, Nigella Lawson, and her husband may be soon embroiled in a fight over marital property after her husband filed for divorce. The husband took the legal action after a spat in a restaurant in which he put his hands on her neck. The husband said that the chef failed to defend him and that led to his decision to divorce her.
It is unknown what kinds of assets that the couple, who has been married for 10 years, has or whether they signed a prenuptial agreement. There should be no child custody issues since they have no children; she has two children from a previous marriage. No details were revealed on whether the husband, who is wealthy in his own right, is asking for any financial support or property.
When it is left up to a judge to decide how marital property should be divided, there are usually many factors that are taken into consideration. A judge may have to look at the length of the marriage, the contributions of a nonworking spouse to the success of the other spouse, a spouse’s ability to obtain employment, and the financial situation of both spouses. It may be a good idea, therefore, for a spouse to obtain legal representation which will ensure that their rights are protected.
